Article 1 : CLASAM Sàrl

  1. CLASAM Sàrl is a limited liability company incorporated under Swiss law with its registered office at 14, chemin de Sous-Cherre, 1245 Collonge-Bellerive/GE, Switzerland and registered in the Commercial Register of the Republic and Canton of Geneva since June 24, 2021.
  2. Its corporate purpose is “the sale of luxury goods over the Internet (e-commerce). It may also carry out any commercial, financial, securities or real estate transactions, as well as any consulting activities, directly or indirectly related to its purpose. It may grant loans or guarantees to associates or third parties”.

Article 2 : General information

  1. CLASAM Sàrl recognizes the importance of your privacy and transparency when processing your personal data. CLASAM Sàrl only collects personal data that is absolutely necessary for its corporate purpose and activities. Registered data is managed with diligence and protected against any form of misuse.

  2. This Privacy Policy describes what personal data is collected when you access and use our website, how and for what purpose we process personal data and the measures we take to safeguard your rights in relation to your personal data.

  3. By accessing our website, you expressly agree to our processing of your personal data in accordance with this Privacy Policy.

  4. We reserve the right to modify this Privacy Policy at any time and without notice, in particular to take account of changes in business practices, technology or applicable data protection legislation. Updates will be posted on our website.

Article 3 : The personal data we collect

  1. We collect the personal data that you provide to us, in particular when you use our website or the services that we offer through it, notably when you place an order or communicate with us.

  2. The information we request is either mandatory or optional. Fields marked with an asterisk are mandatory. Failure to respond to a mandatory data field will prevent us from providing the services offered. Article 4 : How we collect your personal data

  1. Where we process your personal data by automated means, we take appropriate security measures for this purpose.

  2. We process your personal data in accordance with applicable legislation, in particular Swiss data protection law, and adopt appropriate security measures to prevent unauthorized access, disclosure, modification, alteration or destruction of your personal data.

  3. he processing of personal data is carried out using computers or IT tools in accordance with the purposes of this Privacy Policy.
  4. We may process your data in order to remove any information that might identify you, and then use the same anonymized data for purposes not covered by this Privacy Policy (including benchmarking, directing advertising campaigns or developing and marketing new services). You may object to the anonymization of your data at any time.

Article 5 : Purposes of processing your personal data

  1. We process your personal data in order to operate our website and provide you with our services.

  2. We only process your personal data under the following conditions:

    • processing is necessary to fulfil our legal obligations;

  3. Your personal data is collected and processed so that we can provide you with our products, goods and services available on our website, as well as for customer and user management purposes, in particular to contact you about our services and any changes to them.

Article 6 : Product orders and payments

  1. To place an order, you must provide us with your full name, title, complete billing and delivery addresses, telephone number, e-mail address, payment method and related information. Depending on the method of payment chosen, you may be asked to provide a copy of your identity document.

  2. We may also automatically collect data relating to your use of our website in accordance with our cookie policy (art. 15).

  3. We process this data in order to execute the contract for the sale of products or, in the case of uncompleted orders, with a view to its execution.

  4. We use the services of third parties for the payment and dispatch of orders. For example, depending on the payment method selected, you will be redirected to the site of the online payment provider, who will carry out the transaction. We only pass on to these third parties the data necessary for the operations they carry out.

  5. Data concerning completed orders is kept for 10 years. Unfinished orders are kept for three months.

Article 7 : Funding applications

  1. To apply for financing, you must provide us with the following personal information, in order to check whether you meet the relevant conditions:
    1. your employment status (unemployed, permanent contract, fixed-term contract, retired, unable to work, self-employed) ;
    2. your legal status in Switzerland (Swiss nationality, permanent residence permit (Permit C) or residence permit (Permit B) and date of validity) and a copy of your supporting ID.
  2. This data is forwarded to the selected funding partner, who processes it in accordance with its own general terms and conditions and privacy policy. The decision to grant financing is taken by the financing partner autonomously, without any intervention on our part in this process, on the basis of the information you provide, as well as the data collected by our partner itself. Our partner may request the services of credit verification companies.
  3. Any complaint concerning a refusal decision by the financing partner must be addressed to him directly. We have no access to the reasons for refusal and do not intervene in this process.

Article 8 : Contacts and correspondence

  1. You can contact us via our website, by telephone, e-mail or post. In doing so, we process the data you provide us with (in particular surname, first name, means of contact, subject of request).
  2. This data is used to provide you with the requested service. The length of time we keep this data depends on the reason and context of your request. Requests relating to orders are kept for the duration indicated for them. Other requests are normally kept for three months.

Article 9 : Our newsletter

  1. If you subscribe to our newsletter, we will collect your contact details (surname, first name and e-mail address). When our newsletter is consulted, we also collect terminal and access data.
  2. You can subscribe, unsubscribe or re-subscribe to our newsletter at any time. If you unsubscribe, your contact data will be deleted.

Article 10 : Marketing and advertising

  1. In addition to processing your data for the purpose of fulfilling orders, we may also use your data to communicate with you about your orders or certain products for marketing and advertising purposes, in particular to recommend products that may be of interest to you.

  2. You may contact us at any time (art. 17) to object in whole or in part to the use of your personal data for advertising purposes.

  3. The length of time we keep this data varies according to the type of data concerned, but may not exceed three months.

  4. You can also regulate the use of cookies (art. 15), some of which are used by third parties.

Article 11    Statistics and improvement of our services

  1. We may process your personal data, in particular your data relating to the use of our website, as well as your habits and preferences, for internal analysis and statistical purposes, in order to better understand the needs of our users and customers and to improve our services, in particular the ergonomics and functionalities of our website.

Article 13   Communication of your personal data to third parties

  1. We may pass on your personal data to third parties – for example to subcontractors or suppliers of IT services (storage, maintenance, support) or marketing services – if this is necessary for the operation of our website or to comply with a legal obligation.
  2. We may also offer you to use third-party services directly from our website using plug-ins for social networks such as Facebook and Instagram, in which case you acknowledge that the third-party operators of these services may access some of your personal data in connection with our website.
  3. This Privacy Policy applies only to our own website. It does not apply to third-party websites, whether linked to our website or not. These third parties have their own privacy policies, which govern their own rules regarding the collection and use of personal data.

However, exceptionally, in certain specific circumstances, notably for technical or functional reasons, or in the context of contracts with some of our subcontractors, your personal data may be transferred outside Switzerland or an EU/EFTA member state. In such cases, we will use all reasonable means to ensure compliance with the obligations arising from applicable data protection legislation.
  3. You may request further information on this subject and obtain a copy of the relevant guarantees on simple request by contacting us (art. 17).

  1. In order to make browsing more pleasant and to offer certain specific functionalities, we use small text files stored on your computer called cookies. Most cookies are deleted from your hard drive when you close your browser (session cookies). Others remain on your computer and are able to recognize you if you return to the same site (permanent cookies).

  4. You have the right to request that we return your personal data or that it be transferred to the person of your choice, in a structured, commonly used and machine-readable format, without hindrance on our part, subject to our legal obligations.
  5. You have the right to lodge a complaint with the competent data protection supervisory authority.
